1. Acceptance of Terms

By accessing or using PortPilot ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Platform. PortPilot reserves the right to modify these terms at any time. Continued use of the Platform constitutes acceptance of any modifications.

2. Description of Service

PortPilot is a web application generation platform that produces code, interfaces, and architectural components for deployment on the Cardano blockchain. The Platform uses AI-assisted generation to create web applications based on user input and intent.

3. No Custody or Control

PortPilot is a non-custodial platform. We do not hold, custody, or control user funds, private keys, wallet credentials, or blockchain assets at any time. Users maintain full control and responsibility for their own wallets, keys, and transactions.

4. User Responsibilities

You are solely responsible for:

  • The security of your wallet and private keys.

  • All applications generated through the Platform.

  • Testing and validating generated code before deployment.

  • Compliance with all applicable laws and regulations in your jurisdiction.

  • Any smart contracts deployed using code generated by the Platform.

  • The accuracy and legality of content you input into the Platform.

  • Ensuring generated applications meet your specific requirements.

5. No Warranties

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. PortPilot does not guarantee:

  • The accuracy, completeness, or final functionality of generated code.

  • Uninterrupted or error-free operation of the Platform.

  • Compatibility with all blockchain protocols or wallet implementations.

  • The performance, profitability, or success of applications built using the Platform.

6. Generated Code and Applications

All code and applications generated through PortPilot are provided for your use but come with important limitations:

  • Generated code may contain errors, vulnerabilities, or unintended security behavior.

  • Users must review, test, and audit all generated code before deployment, especially for production environments.

  • PortPilot is not responsible for any losses resulting from deployed applications.

  • Smart contracts generated through the Platform have not been formally audited unless explicitly stated by PortPilot.

  • Users are responsible for obtaining independent security audits of any production deployments.

7. Blockchain Risks

Using blockchain technology involves inherent risks, including but not limited to:

  • Irreversible transactions.

  • Smart contract vulnerabilities.

  • Network congestion and variable transaction fees.

  • Protocol changes or hard forks.

  • Loss of private keys resulting in permanent loss of access.

  • Regulatory uncertainty.

You acknowledge these risks and agree that PortPilot bears no responsibility for losses arising from blockchain-related issues.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PORTPILOT, ITS DEVELOPERS, MAINTAINERS, CONTRIBUTORS, AND AFFILIATES SHALL NOT BE LIABLE FOR:

  • Any direct, indirect, incidental, consequential, special, or punitive damages.

  • Loss of profits, revenue, data, or use.

  • Financial losses from deployed applications or smart contracts.

  • Security breaches, hacks, or exploits of generated code.

  • Regulatory actions or legal consequences.

  • Technical failures, bugs, or errors in generated applications.

  • Any damages arising from your use or inability to use the Platform.

This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and even if PortPilot has been advised of the possibility of such damages.

9. Indemnification

You agree to indemnify, defend, and hold harmless PortPilot, its developers, maintainers, contributors, and affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use of the Platform.

  • Applications you generate or deploy.

  • Your violation of these Terms of Service.

  • Your violation of any applicable laws or regulations.

  • Any third-party claims related to your generated applications.

10. Token Economics

If you participate in the PortPilot token ecosystem:

  • Tokens are acquired at your own risk.

  • Token value may fluctuate significantly.

  • There is no guarantee of liquidity or market availability.

  • PortPilot makes no representations about token value or investment returns.

  • Tokens are not securities and should not be treated as investments.

  • You are responsible for tax implications in your jurisdiction.

11. Prohibited Uses

You may not use PortPilot to:

  • Generate applications for illegal purposes.

  • Create malicious software, scams, or fraudulent schemes.

  • Violate intellectual property rights.

  • Attempt to exploit, hack, or disrupt the Platform.

  • Generate applications intended to harm users or systems.

12. Intellectual Property

Generated code and applications belong to the user who generated them. However:

  • PortPilot retains all rights to the Platform itself, including the underlying templates, systems, and infrastructure.

  • Users grant PortPilot a license to use anonymized and aggregated generation data solely for the purpose of improving the Platform's core engine and functionality.

PortPilot does not provide investment, financial, legal, or tax advice. Nothing in the Platform, documentation, or communications should be construed as:

  • A recommendation to use specific technologies or approaches.

  • Financial or investment advice.

  • Legal guidance on regulatory compliance.

  • Tax advice or guidance.

Consult qualified professionals for advice specific to your situation.

14. Alpha/Beta Testing

During alpha and beta phases:

  • The Platform may contain bugs, errors, or incomplete features.

  • Features may change or be removed without notice.

  • Data may be lost or corrupted.

  • Access may be restricted or revoked.

  • No guarantees are made about feature availability or timeline.

15. Termination

PortPilot reserves the right to:

  • Suspend or terminate your access at any time, for any reason.

  • Modify or discontinue the Platform without notice.

  • Remove generated applications from our systems.

Termination does not extinguish any of your obligations or responsibilities regarding applications you deployed prior to termination.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full effect.

17. Entire Agreement

These Terms of Service constitute the entire agreement between you and PortPilot regarding the use of the Platform.
